1. Agreement to Terms

By accessing or using the Sew Smart Assistants service ("Service") provided by Sew Smart AI, LLC ("Company," "we," "us," or "our"), you ("you" or "Subscriber") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sew Smart Assistants is a subscription-based service that provides access to AI-powered chatbot assistants specializing in sewing, quilting, embroidery, serging, needlework, and sewing machine guidance. The Service includes access to all available assistants as part of a single subscription.

The assistants are designed to provide general guidance, tips, and educational information. They are not a replacement for professional instruction, machine repair services, or manufacturer support.

3. Subscription Plans and Billing

3.1 Plans

We offer the following subscription plans:

  • Monthly Plan: $9.99 per month, billed monthly
  • Yearly Plan: $99.99 per year, billed annually

All plans include access to all available assistants. Prices are in U.S. dollars and are subject to change with notice.

3.2 Billing

Subscriptions are billed automatically at the beginning of each billing cycle (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize us to charge your selected payment method on a recurring basis.

3.3 Free Trials and Promotions

We may offer free trials or promotional pricing from time to time. At the end of a trial or promotional period, your subscription will automatically convert to the standard plan rate unless you cancel before the trial or promotion ends.

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access to the Service through the end of your current paid billing period.
  • Your subscription will not renew, and no further charges will be made.
  • No partial refunds are issued for unused time within a billing period.

4.2 Refunds

5. Account Registration and Security

5.1 Account Information

You must provide accurate and complete information when creating your account. You are responsible for maintaining the accuracy of your account information.

5.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5.3 One Account Per Person

Each subscription is for individual use only. You may not share your login credentials with others or allow multiple people to use a single subscription.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models, training data, or proprietary systems
  • Use automated tools, bots, or scripts to access the Service
  • Resell, redistribute, or commercially exploit the Service or its outputs
  • Harass, abuse, or harm others through the Service
  • Attempt to circumvent access controls or security measures
  • Use the Service to generate content that infringes on third-party intellectual property

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, content, AI models, training data, assistant personas, and branding, is the property of Sew Smart AI, LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes during your active subscription.

7.2 Your Content

Any questions, text, or other content you submit through the Service ("User Content") remains yours. By using the Service, you grant us a limited license to process your User Content solely to provide the Service. We do not use your User Content to train AI models.

8. Privacy

Your privacy is important to us. Key points:

  • We do not sell your personal information.
  • We do not share your chat conversations with third parties.
  • We do not use your conversations or personal data to train AI models.
  • We collect only the information necessary to provide and improve the Service.

9. Disclaimers

9.1 No Professional Advice

The information provided by the assistants is for general educational and informational purposes only. It is not a substitute for professional instruction, machine repair, or manufacturer guidance. Always refer to your machine's manual and consult qualified professionals for repairs or safety concerns.

9.2 Accuracy

While our assistants are trained on carefully curated industry knowledge, we do not guarantee the accuracy, completeness, or reliability of any information provided. AI-generated responses may occasionally contain errors.

9.3 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEW SMART AI, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Sew Smart AI, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may add, remove, or modify assistants, features, or content at our discretion.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and notify you via email or through the Service. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Blount County, Tennessee.
